Open Data Albania is exploring on the number of procedures and the limit fund for direct negotiated Public Procurements announced and performed by 61 local government units, municipalities, following the new administrative territorial division. This research article is based on data released from the portal database on Transparent Procurement. This portal contains information on every public procurement procedure for 61 new local government units from July 2015 onwards.

Direct negotiations are public procurement procedures whereby the contracting authority consults the economic operators of their choice and negotiates the contract terms with one or more of these.  The decision to apply this procedure must be argued by the authority, who has to present the conditions forcing this authority to act as such. Since direct negotiations are procurements without competition they carry the risk of high exposure to abuse of the fund.

It turns out that during this period one hundred and fifty direct negotiated public contracts are finalized. The fund for these direct negotiated public contracts is 585. 83 million ALL. Each of these public procurement procedures is listed in Transparent Procurement portal: ‘Selection of the type of procedure With Negotiations’.

Municipalities of Tirana, Elbasan, Kamza, Vau i Dejës, Rrogozhina, Korça and Lezha are municipalities with the greatest number of cases and the highest values proceeded with direct negotiations. Direct negotiations will be also considered additions to the contracts. Procurement Authorities apply the later whenever they observe violations of deadlines of tendering purchases and when making evaluations for additional works and services.

Only 37 of the 61 municipalities have applied direct negotiation procedures. Direct negotiations with an amount of over 5 million ALL (new) are performed from Elbasan, Tirana, Maliq, Konispol, Vau Deja, Rrogozhina and Kamza municipalities.

This portal intends that all data concerning tender procedures and public contracts concluded from the sixty-one municipalities in the country are transparent and easily obtainable. According to research filters, these procurements can be categorized by type of the contract finalizing the tender such as Public Works (investments), Supply of Goods (purchases), and Services etc. Categorization according to the number of participants in the competition and evaluation of the difference between the limit fund and the value of the winning bid may be probably made for each tender.

An updated information is also provided with regard to the number of participants in the race, the winner according to the bid, the status of the project, the deadline of the contract implementation and payment of any contract by treasury transactions. AIS organization is the implementer of this project. This organization is a promoter of Open Data Albania.
