{"id":17572,"date":"2022-07-20T06:57:44","date_gmt":"2022-07-20T06:57:44","guid":{"rendered":"http:\/\/ndiqparate.al\/?p=17572"},"modified":"2022-07-20T12:14:13","modified_gmt":"2022-07-20T12:14:13","slug":"money-laundering-in-the-context-of-the-fiscal-and-criminal-amnesty-ais-position-analysis-and-conclusions","status":"publish","type":"post","link":"https:\/\/ndiqparate.al\/?p=17572&lang=en","title":{"rendered":"Money Laundering in the Context of the Fiscal and Criminal Amnesty, AIS position, Analysis and Conclusions"},"content":{"rendered":"\n<p>Albanian Institute of Science has carefully analyzed the draft law on &#8220;Fiscal and Criminal Amnesty of entities submiting voluntary declaration\u201d initiated by the Ministry of Finance and the Ministry of Justice and presented for Public Consultation by the Albanian Government on June 23, 2022. The deadline for the submission of opinions and recommendations on the draft daw during the consultation process is July 23, 2022.<\/p>\n\n\n\n<p>The organization examined various aspects related to the country\u2019s current circumstances and the amnesty, such as: the fiscal policy and administration; the degree of informality; the fight against corruption and the risk of money laundering as a result of criminal offences. Likewise, a separate report analyzed issues of harmonization of the draft with the national criminal legislation, testing the principle of legal safeguards.<\/p>\n\n\n\n<p>In the end, the two Documents drafted were presented in a meeting, held on July 19th, with guests and participants from the relevant institutions, international organizations in the country, representatives from EU countrues Embassies, field experts and civil society actors and the Media.<\/p>\n\n\n\n<p><a href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2022\/07\/Final-Agenda-July-19th-.-Money-Laundering-in-the-Context-of-Fiscal-and-Criminal-Amnesty.pdf\">Event agenda<\/a><\/p>\n\n\n\n<p>The two Documents contain an analysis, conclusions, recommendations, as well as short-term and long-term alternatives to the recent Fiscal and Criminal Amnesty. More specifically:<\/p>\n\n\n\n<ul><li>Policy Position Paper: Money Laundering in the Context of Fiscal and Criminal Amnesty LINK <a href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2022\/07\/AIS-POLICY-POSITION-PAPER-Money-Laundering-in-the-Context-of-Fiscal-and-Criminal-Amnesty-July-2022.pdf\" style=\"color: #159eee;\">(See more HERE)<\/a><\/li><li>Technical Report: Fiscal Amnesty&nbsp; Issues and Problems of Harmonization with the Criminal Legislation LINK <a href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2022\/07\/AIS-REPORT-Fiscal-Amnesty-Issues-and-Problems-of-Harmonization-with-the-Criminal-Legislation-July-2021.pdf\" style=\"color: #159eee;\">(See more HERE) <\/a><\/li><\/ul>\n\n\n\n<p>The Policy Position Paper and the Technical Report were presented as part of civil society initiatives, which aim to contribute to the Country\u2019s European integration.<\/p>\n\n\n\n<p>Both documents will be submitted to the Albanian government, the Parliament of Albania and Stakeholders, as official Position and Recommendations from civil society.<\/p>\n\n\n\n<p>Conclusions, Recommendations and Alternatives, as presented on the July 19th event <a href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2022\/07\/AIS-Conclusions-Recommendations-and-Alternatives-July-2022.pdf\">(See more HERE)<\/a><\/p>\n\n\n\n<p>The Albanian Institute of Science, widely referenced as <a href=\"https:\/\/ndiqparate.al\/?page_id=10789&amp;lang=en\">Open Data Albania<\/a>, will continue to participate in the process of consultation and technical discussion concerning the present draft law, even when the latter will be submitted for debate in the Assembly.<\/p>\n\n\n\n<p>We deem our participation of paramount importance, given the importance of the process, the assessed risks, issues of the legal framework and harmonization of the legislation, and many other fecets related to the governing majority initiative.<\/p>\n\n\n\n<p>AIS has also prepared an Analytical Report on the History of Fiscal Amnesties and Voluntary Asset Declarations in Albania from 2008 to 2017.<strong><u><\/u><\/strong><\/p>\n\n\n\n<p>The Policy Document \u201cMoney Laundering in the Context of the Fiscal and Criminal Amnesty\u201d was drafted by the Albanian Institute of Science AIS\/Open DataAlbania, in implementation of the <a href=\"http:\/\/cluster1albania.com\/?fbclid=IwAR3dEVg6M0yKBCmN1L8m3wqGhneYPItQrPYQTvXXpkq0XdBNoYgkWqwYpMA\">C1 &#8211; EU &#8211; NPA<\/a> project \u201cImproving the Debate on Policies and Accountability for Fulfilled Basic Rights\u201d through the creation of the Negotiation Platform of Cluster1 Albania. The <a href=\"http:\/\/cluster1albania.com\/?fbclid=IwAR3dEVg6M0yKBCmN1L8m3wqGhneYPItQrPYQTvXXpkq0XdBNoYgkWqwYpMA\">C1 \u2013 EU \u2013 NPA<\/a> project is implemented by four Albanian organizations: Center for the Study of Democracy and Governance CSDG, Institute of Political Studies ISP, Albanian Committee of Helsinki KSHH and Albanian Institute of Science AIS, with the support of the Embassy of the Kingdom of the Netherlands in Tirana.<\/p>\n\n\n\n<p>The Findings, Opinions or Recommendations expressed in this Document represent the viewpoint of experts and AIS and do not necessarily reflect those of our partners or supporters of the <a href=\"http:\/\/cluster1albania.com\/?fbclid=IwAR3dEVg6M0yKBCmN1L8m3wqGhneYPItQrPYQTvXXpkq0XdBNoYgkWqwYpMA\">C1-EU-NPA<\/a> Project.<\/p>\n\n\n\n<figure class=\"wp-block-image\" id=\"block-63cd80d3-e1f6-4d28-8546-6f202b16632c\"><img src=\"https:\/\/i0.wp.com\/ais.al\/new\/wp-content\/uploads\/IMG_5253.jpg?w=790\" alt=\"This image has an empty alt attribute;
